What documents are needed to open a maintenance point

The first step is to acquire a certificate from the Russian Union of Motor Insurers. This is an organization that controls all maintenance points that are in “private hands”. To obtain such a certificate authorizing the work of TO, you need to submit an application of the appropriate sample with the attached package of the following documents:

  • Certificate of state registration as an individual entrepreneur.
  • TIN registration.
  • Extract from the EGRIP.
  • Documents certifying the ownership of the premises in which the maintenance point will be organized.

The deadline for consideration of the application to the RAS is 10 days, after which either a positive decision must be made, as a result of which the data on the new maintenance point will be entered in the register, or a negative one, the basis for which may be false information submitted, or the attached documents are drawn up incorrectly.

For accreditation, an annual payment is established, plus it will also have to pay every year for each declared category of the right to conduct maintenance.

One of the most controversial aspects of the new vehicle inspection system lies, in fact, in the very interpretation of the situation that has arisen. So, many believe that it has become worse than before. An opinion has formed in society that insurers have monopolized everything, introduced schemes that deform the law, and corruption has surpassed all conceivable limits that existed before the change in the maintenance order. Mostly these are the voices of technical inspection operators who have moved to the new infrastructure from the previous system, formed by the Ministry of Internal Affairs of Russia in accordance with Decree N 880 of the Government of the Russian Federation.
In the meantime, all the circumstances of the abuses that have arisen (such as the issuance of technical inspection coupons without actually carrying out technical diagnostics) are dealt with by the relevant authorities, the so-called old operators incur losses. On the one hand, these are losses from the moratorium on car inspections introduced in June 2011 (Decree of the Government of the Russian Federation N 413). On the other hand, it comes from the new interpretations of the Federal Law N 170-FZ, when it is easier for car owners to bypass the law and make an inspection according to a "curve" scheme. For the main thing here is to get it, because a tangible fine is provided for its absence.
At the same time, the new TO mechanism has its advantages. Judge for yourself: car owners have the opportunity to pass a technical inspection anywhere in the country, regardless of the place of registration of the car and, accordingly, regardless of the preferences of the traffic police inspector. Technical inspection has become significantly cheaper - the maximum fee for it is available to any car owner. Today, the price of checking the technical condition in many regions of Russia hardly exceeds 300-400 rubles, that is, the cost of ten to fifteen liters of fuel.
In addition, the Law provides for sanctions against unscrupulous participants in the technical inspection system, up to the deprivation of an accreditation document. Moreover, if the car owner believes that the maintenance point violates his rights, he has the right to refuse such services, go to another point for technical inspection, and also complain about the illegal actions of the operator. Another positive innovation of the Federal Law N 170-FZ, which I would also like to note: now we know all the participants in the technical inspection market, as they say, by sight. Thanks to the openness of information in the register of operators maintained by the Russian Union of Motor Insurers (RSA), we understand who is involved in technical inspection, where maintenance points are located, and most importantly, how many there are. By the way, it was this provision of the Law that revealed that there were clearly not enough maintenance operators in previous years (in proportion to the volume of the Russian vehicle fleet). This fact, in fact, gave rise to dissatisfaction among car owners and stimulated the emergence of a shadow market for the sale of state inspection coupons.
Now, literally from the very first day of the entry into force of the Federal Law N 170-FZ, the infrastructure of maintenance points is developing dynamically, which can be clearly seen in the growth in the number of maintenance operators in the RSA register.

Market Pass

Thanks to the technical inspection reform, new players gained access to this market, including key place rightfully belongs to operating maintenance enterprises, or car services. Experience, availability of specialists and material and technical base make it easier for them to enter the technical inspection market than for entrepreneurs who want to organize such a business from scratch.
Therefore, for technical service enterprises, the TO reform is a historically significant moment (as you know, under the previous legislation, within the framework of Decree of the Government of the Russian Federation of July 31, 1998 N 880, they did not have the right to participate in the inspection of motor vehicles).
Let's move on to the practical implementation of the maintenance item. In order to obtain permission to conduct a technical inspection, there are Accreditation Rules fixed in the Order of the Ministry of Economic Development of Russia dated November 28, 2011 N 697. The rules are in principle simple and fit in several lines:
a) the presence in ownership or on another legal basis of facilities and means of technical diagnostics;
b) the availability of technical capabilities for the daily transmission of information on the results of the technical inspection to a single automated technical inspection system;
c) the presence of at least one technical expert in the state.
It should be recognized that accreditation is a complex and multifaceted process, crossed from a variety of regulatory legal documents. And this, as practice shows, is a fundamental difficulty for independent car services. Due to their limited material and technical resources, many are not able to maintain qualified lawyers on the staff, and for some STOA directors, regulations are just a dense forest.
In organizational terms, the creation of a technical inspection point is by no means fast process. If you start from scratch, purely technologically, the accreditation cycle takes 3-6 months. During this time, several key tasks must be completed.
First, you need to order, buy, install and put into operation the necessary diagnostic equipment. There are several suppliers of these products in Russia, and they are now overloaded with orders. Accordingly, the delivery and installation time is increased. The cost of an average set of equipment ranges from one (Russian-made) to two million rubles (import), if we are talking on the line of technical control of cars of category M1.
Secondly, it is necessary to hire and include technical experts in the staff, and this is not an easy task, since in the new legislation the requirements for specialists of maintenance points have increased significantly. Technical universities quickly responded to new trends, and now they are ready to offer training courses under the program "Expert in technical control and diagnostics of motor vehicles" in full compliance with the requirements of the Order of the Ministry of Industry and Trade of Russia dated December 1, 2012 N 1664.
The number of technical experts at the maintenance point depends on the region of accreditation, the number of diagnostic lines and technical control posts, as well as on the requirements of the labor legislation of the Russian Federation. In accordance with the Order of the Ministry of Finance of Russia N 155-n, the standards for providing TTO and MSTO forms and, accordingly, throughput inspection points are limited by the working time fund established by law. In other words, it is forbidden for one technical expert to work 24 hours, 7 days a week, 365 days a year without breaks and days off, setting records for the number of vehicle checks per unit of time.
Thirdly, it is necessary to create a system for documenting and transmitting data on transport checks. This issue is easier, since everyone now has computers and Internet access.
Fourth, on final stage of the entire preparation process, it is necessary to put together and send the applicant's documents for accreditation to the RSA. In reality, this kit is a hefty folder, but it is actually your pass to the technical inspection infrastructure with the right to make decisions on the admission of vehicles to participate in road traffic.

There are vacancies on the market

It is obvious that a new system of technical inspections cannot be formed overnight. According to the current provisions of the Federal Law, a transitional period is provided until January 1, 2014. State inspection stations and maintenance points that worked under Decree N 880 and had agreements with the territorial divisions of the Ministry of Internal Affairs must be accredited before the specified period. In the meantime, they are included in the RSA register in a simplified declarative procedure. Today there are 2715 such points throughout Russia. To these should be added 434 new maintenance stations that have passed the full cycle of accreditation in the RSA (as of March 15, 2012). In order to answer the questions whether this number of TOs is enough and whether there is a commercial interest to take part in the registration of new TOs, it is important to emphasize the following. At one time, a proportion was established that one diagnostic line should account for 10,000 checks of motor vehicles per year. To date, 48 million vehicles have been registered in Russia. Based on established standards, the number of technical inspection lines should be at least 4800 units. At the moment, there are already more than 3000 maintenance points. Now new operators are added 5 - 7 per day. If such dynamics continue, by the end of the year we will be able to approach the minimum required quantity checkpoints. At the same time, I cannot help but recall that the RAMI previously stated the need to create 10,000 points on the territory of Russia.
As for the commercial side of the matter, participation in the maintenance system for car services has the following advantages: in addition to directly earning money by conducting technical inspections, the inspection operator sells OSAGO policies (along the way and hull insurance, as well as other insurance products) and receives a commission from insurers . In this situation, a certain client flow is formed for restoration repairs after an accident, and this is also additional income because, alas, we have not yet learned how to drive without accidents. Well, in general, the organization of a technical inspection point is an obvious contribution to expanding the range of services offered at service stations and effective remedy to retain and expand the customer base. So there are still vacancies in the new technical inspection system, but at the same time I recommend that car services that are only thinking about participating in this infrastructure do not hesitate to make a decision.

In the summer of 2011, the inspection function was transferred from the traffic police to private companies. Now everyone can open their inspection and earn money on it. The documents required to open a private technical inspection are as follows.

Constituent documents (copies);
- a copy of the passport of an individual entrepreneur;
- extract from the USRIP or USRLE;
- copies of documents that confirm the ownership of structures (or lease), as well as technical diagnostic tools with approved relevant technical characteristics;
- copies of documents that confirm the possibility of transferring information to the UAIS TO;
- copies of documents confirming that the organization has at least one technical expert who meets the necessary approved requirements;
- a copy of the document confirming that the person who signed the application has the right to act on behalf of the legal entity;
- description of attached documents;
- a copy of the payment bank order, which confirms the payment for accreditation.

The owner of a commercial inspection point has the option to choose either one or several areas for accreditation, that is, in which categories of vehicles he has the right to inspect. Vehicle categories are as follows:
- motorcycles (L);
- vehicles that are used for the carriage of passengers and have no more than eight seats, except for the driver (M1);
- vehicles for the carriage of passengers with more than eight seats, except for the driver, and a mass of not more than 5 tons (M2);
- vehicles for the carriage of passengers with more than eight seats, except for the driver, and a mass of more than 5 tons (M3);
- cargo vehicles weighing no more than 3.5 tons (N1);
- cargo vehicles weighing more than 3.5 but not more than 12 tons (N2);
- goods vehicles with a mass of more than 12 tons (N3).

After your application is received by the RAS, within 10 working days a decision is made to issue a certificate or to refuse, which may be if the applicant submitted false data or documents were drawn up with deviations from the requirements. If a positive decision is made, all information about the new operator is entered into the official register.

According to a special decree of the Government of the Russian Federation on the amount of the fee for accreditation, you will have to pay 20 thousand rubles and, in addition, 10 thousand rubles for each of the checkpoints indicated in the application. Accreditation must be confirmed annually, which will cost 15,000 rubles plus another 10,000 rubles for each inspection point.

If you chose some areas of work at the beginning of the company’s work, and then you are going to expand their number, if you changed the name of the company or the personal data of the owner, then you will have to reissue the accreditation certificate, for which you need to pay 15 thousand rubles plus 10 thousand for each item THAT.

An increase in the number of checkpoints will also require a renewal of the certificate, for which you will have to pay 10 thousand rubles and 10 thousand for each point that you indicated in the application.

Any room for a maintenance point can be used, as long as the area is suitable. But special equipment is needed. Order of the Ministry of Industry and Trade of Russia dated December 6, 2011 No. 1677 "On approval of the main technical characteristics of technical diagnostic tools and their list" established next composition equipment:

- diagnostic equipment for external lighting devices, to check the adjustment of headlights and luminous intensity;
- tire diagnostic tools (ruler and caliper);
- diagnostic equipment for the engine and for its systems (smoke meter, gas analyzer, device for monitoring the speed and oil temperature, a universal device that determines the content of pollutants in exhaust gases, a leak detector that checks the tightness of the power system, sound level meter);
- means for diagnosing other elements (a device that checks the light transmission of glass, a ruler);
- compressor, tips, pressure gauge.

According to the owners of this type of business themselves, all equipment for vehicle inspection can cost from 250 thousand to one million rubles. If you purchased any equipment for technical inspections, but did not keep the relevant documents about it, the fact of owning it can be a certificate of its inspection, which is issued by the Federal Agency for Metrology and Technical Regulation. There are committees of this agency in the regions.

With the premises and equipment, everything is more or less clear, but there are many questions about the requirement for the presence of a qualified expert at each point of technical inspection.

The technical expert must meet certain qualification requirements. It is he who diagnoses cars, decides whether or not to issue a technical inspection coupon, and assures him with his signature. The expert must have the necessary education, work experience and skills. According to the Order of the Ministry of Industry and Trade of Russia, the requirements are approved, according to which a specialist who has:
- professional higher education in the field of motor transport activities, confirmed by a state diploma, or non-core higher plus a document on advanced training, or secondary profile with a diploma on advanced training. That is, the higher education of an expert may not be on automotive topics, but must be obtained at a technical university. And he will need to take courses under the advanced training program "Expert of technical control and diagnostics of vehicles" with a certificate or diploma. This year, it is still allowed that instead of a document on advanced training in accordance with the program “Expert of technical control and diagnostics of vehicles”, an expert has a document confirming his advanced training in a program designed for controllers;
- a driver's license and driving experience of at least three years, and for those categories of vehicles that he will have to inspect;
- practical experience. An expert must not only have the necessary knowledge, but also have the skills practical work in production conditions or in conditions of control or repair of vehicles. There are restrictions on the minimum experience - those who have a higher education must have at least two years of work experience in their specialty, and those who have a secondary education - at least three years.

Before the new law came into force, when passing an inspection, you had to pay a state duty (300 rubles) and the cost of inspection. Starting this year, commercial vehicle inspections only charge for the inspection itself, no duty. The amount of the cost of services is limited, and separately for each subject of the Federation. The most expensive technical inspection is in Moscow and in the Primorsky Territory. In other areas, the cost has not changed much and, depending on the region and category vehicle, can range from 100 to 2300 rubles.

Companies that conduct technical inspections have the right to independently set prices for their services, with only one condition: they cannot be higher than the maximum tariff.

Maintenance operators have the right to conclude agreements with the PCA and with manufacturers of vehicle inspection coupon forms, so that they themselves provide themselves with new forms.

Companies that are accredited for this work must transmit every day to a single automatic system (UAIS TO) data on technical inspections that they have carried out and on coupons that they have issued. First of all, these data are necessary for insurance companies, since an OSAGO policy can now be issued only if there is a technical inspection coupon, which is issued for a period of six months. Special software for data transfer is not required: it is done through the traffic police website.

The validity of the certificate may be suspended if, for example, when transferring information to the UAIS TO, you made a mistake, violated the accepted procedure for passing technical inspection, or failed to pass the annual procedure confirming that your item meets the established requirements. If there are two such violations within a year, the certificate is subject to cancellation.

Most technical inspection points are opened at existing car repair shops. The law does not restrict the combination of these activities. The owner of the technical inspection point does not have the right to conduct a technical inspection of his vehicle, since the basis for the inspection is a contract, and it is impossible to conclude an agreement with oneself. This contract does not exist in paper form, since payment for inspection services is a confirmation of the conclusion of the contract.

The smallest starting capital with which you can open your own technical inspection point is 500 thousand rubles. If there are no other sources of income (for example, a car repair shop), these investments will pay off in one year.

In July 2011, the Federal Law “On the Technical Inspection of Vehicles and on Amendments to Certain Legislative Acts” was adopted. Russian Federation". In accordance with this law, since 2012, the technical inspection, which was previously handled by the traffic police, was transferred to commercial organizations - independent inspection points. They not only deal with the technical part (they conduct the inspection itself), but also draw up everything Required documents. In order to obtain the status of a technical inspection point, you must have an accreditation certificate from the Russian Union of Motor Insurers (RAS). The same organization also controls the activities of private checkpoints. To obtain an accreditation certificate, it is enough to send a letter to the RAS (or bring it in person) with an application and the following documents:

  • copies of constituent documents;
  • a copy of the identity document of the individual entrepreneur;
  • extract from the Unified State Register of Legal Entities or EGRIP;
  • copies of documents confirming the ownership of facilities (or leases) and technical diagnostic tools with the corresponding approved technical characteristics;
  • copies of documents confirming the possibility of transferring information to the UAIS TO;
  • copies of documents that confirm the presence in the organization's staff of at least one technical expert who meets the approved requirements;
  • a copy of a document confirming the authority of the person whose signature is on the application to act on behalf of the legal entity;
  • description of attached documents;
  • a copy of the payment order with a bank mark confirming the payment of the accreditation fee.

The owner of a commercial inspection station can choose one or more areas of accreditation, that is, the categories of vehicles that he is authorized to inspect. There are the following categories of vehicles: motor vehicles (L); vehicles used for the carriage of passengers and having no more than eight seats in addition to the driver's seat (M1); vehicles used for the carriage of passengers, having, in addition to the driver's seat, more than eight seats, and the maximum mass of which does not exceed five tons (M2); vehicles used for the carriage of passengers and having, in addition to the driver's seat, more than eight seats, with a maximum mass exceeding five tons (M3); vehicles intended for the carriage of goods and having a technically permissible maximum mass of not more than 3.5 tons (N1); vehicles intended for the carriage of goods, having a maximum mass of more than 3.5 tons, but not more than 12 tons (N2); vehicles for the carriage of goods weighing over 12 tons (N3), etc.

Within ten working days from the date of receipt of your application, the RAS makes a decision to issue an accreditation certificate or to refuse (for example, if the documents were not drawn up in accordance with the requirements or if the applicant submitted false data). If a positive decision is made, all information about the new operator is entered into the official register.

For an accreditation certificate, in accordance with Decree of the Government of the Russian Federation of 03.11.2011 No. 912 “On the amount of the fee for accreditation in the field of technical inspection”, you will have to pay 20 thousand rubles, as well as 10 thousand rubles for each item of technical inspection, which was indicated in the application. Annual confirmation of compliance with accreditation requirements will cost 15 thousand rubles, plus again 10 thousand rubles for each technical inspection point.

If at the beginning of the existence of your company you choose several areas (for example, L , M1, M2), and in the future you are going to expand their number, if your company changes its name or if the personal data of the owner changes, then in all these cases it is necessary to reissue the accreditation certificate will pay 15,000 rubles plus 10,000 rubles for each item of technical inspection.

If you are going to increase the number of your technical inspection points, then reissuing a certificate will cost 10 thousand rubles, plus another 10 thousand rubles for each inspection point indicated in the application.

For the organization of a maintenance point, almost any room of a suitable area is suitable. But without special equipment not enough. The requirements for it are given in the order of the Ministry of Industry and Trade of Russia No. 1677 dated December 6, 2011 "On approval of the main technical characteristics of technical diagnostic tools and their list."   • equipment for diagnosing the engine and its systems (gas analyzer, smoke meter, device for measuring engine speed and oil temperature, or a universal device for measuring the content of pollutants in exhaust gases, which replaces the previous three devices; leak detector for checking the tightness of the gas supply system; sound level meter) ;
  • means of technical diagnostics of other elements (a device for checking the light transmission of glasses and a regular ruler);
  • tips with pressure gauge and compressor.

According to the owners of this type of business themselves, the total cost of equipment required for vehicle inspections ranges from 250-300 thousand to 1 million rubles. If you do not have documents on the purchase of any equipment for technical inspections, you can confirm the fact of ownership of it with certificates of its inspection issued by the Federal Agency for Technical Regulation and Metrology. A technical expert is an employee who meets certain qualification requirements. He carries out technical diagnostics of cars, and it is he who decides on the issuance of a technical inspection coupon and certifies it with his signature. The expert must have certain education, skills and work experience, in accordance with the Order of the Ministry of Industry and Trade of Russia No. 1664 dated December 1, 2011 “On approval of qualification requirements for technical experts”. In particular, a specialist who has:

  • higher professional education in the field of motor transport (and a state-recognised diploma confirming the existence of such) or higher non-core plus a diploma of advanced training or secondary profile plus a diploma of advanced training. Please note: the higher education of an expert may not be related to road transport, but it must be obtained at an engineering and technical university (and be confirmed by a state diploma). He will also need to take advanced training courses under the program "Expert in technical control and diagnostics vehicles and receive a diploma or certificate. This year, it is still allowed for an expert to have a document on advanced training under the program for inspectors instead of a document on advanced training under the program "Expert in technical control and diagnostics of motor vehicles".
  • driver's license and a total driving experience of at least three years. The technical expert must have a driver's license for the categories of vehicles that he inspects.
  • practical work experience. An expert must have not only theoretical knowledge, but also practical skills in the conditions of production, maintenance, repair or monitoring of the condition of vehicles. The law also has restrictions on the minimum work experience. Holders of higher professional education must work in their specialty for at least two years, and holders of secondary special education- not less than three years.

Before the entry into force of the new law, the fee for passing a technical inspection consisted of a state duty (300 rubles) and the cost of the technical inspection itself. Starting from this year, commercial vehicle inspection centers will only charge a fee for the inspection without duty. The maximum amount of the cost of these services is determined for each subject of the federation separately. The most expensive technical inspection will cost in the Moscow region and in the Primorsky Territory.

In most other regions, the cost of this procedure has not changed much (from 100 to 2300 rubles, depending on the vehicle category and region). Inspection companies have the right to set their own prices for their services. The only requirement is that they cannot be higher than the maximum established tariff.

Maintenance operators have the right to conclude tripartite agreements with the PCA and manufacturers of technical inspection coupons, which allows them to independently provide themselves with new forms.

All duly accredited companies are required to transmit data on their technical inspections and issued coupons to a single automated system (UAIS TO) on a daily basis. This data is necessary, first of all, for insurance companies, since this year an OSAGO policy is issued only if there is a technical inspection coupon, the validity of which expires no earlier than six months later. No special software is required for data transfer. It is carried out through the website of the traffic police.

The validity of the certificate may be suspended if, for example, you made a mistake when transferring information to a single automated system, violated the technical inspection procedure, or failed to pass the annual procedure to confirm that your item complies with the established requirements. After two such violations during the year, the certificate is canceled.

Many inspection points are opened on the basis of already existing auto repair shops. The law does not prohibit the combination of these activities. At the same time, the owner of the technical inspection point himself is not entitled to conduct a technical inspection of his own vehicle. Since the inspection is carried out on the basis of an agreement, and it is impossible to conclude an agreement with oneself. Please note: there is no need to sign an agreement with your customers in paper form, since payment for technical inspection services automatically confirms the fact of the conclusion of the agreement.

The minimum starting capital for opening your own technical inspection point is 500 thousand rubles. In the absence of other sources of profit (for example, a car repair shop), the payback period for these investments is about one year.

The Ministry of Economic Development of Russia issued an order that defines the rules for accreditation of technical inspection operators. The document specifies in detail what you need to have and what documents to provide in order to obtain the right to conduct maintenance, as well as the requirements that the operator must meet.

First, a company that wishes to carry out an inspection must apply for an accreditation certificate. The document is submitted to the professional association of insurers (PCA) on paper. You can bring it in person, you can send it by mail.

The application must contain the following information: the full and abbreviated name of the applicant, its location in accordance with the constituent documents, the state registration number of the entry on the creation of the legal entity, the data of the document confirming the fact of entering the information in the Unified State Register of Legal Entities, indicating the body that carried out the state registration. The application also indicates the surname, name, patronymic of the head of the company or individual entrepreneur. For an individual entrepreneur, it is also necessary to indicate the place of residence, the details of an identity document and data confirming his right to engage in commercial activities. It is also necessary to indicate contacts (phone numbers, postal address, e-mail addresses) and data on registration with the tax authority. The number and addresses of maintenance points are also indicated in the application.

In addition to the application, copies of the applicant's constituent documents (for individuals), copies of the applicant's identity document (for individual entrepreneurs), copies of documents confirming the availability of technical diagnostic facilities and means, copies of documents confirming the availability of technical capabilities for daily transfer of information about the results of the technical inspection to a single automated technical inspection system, copies of documents confirming the presence of at least one technical expert in the state and an inventory of all these documents.

The PCA registers the application within one day and considers it within five working days. If the set of documents does not comply with this law, the RAMI within 7 days sends a reasoned notice to the applicant on the need to eliminate the shortcomings, indicating inaccuracies. If everything is correct, PCA conducts a documentary check within 10 days. Then, within three working days, the PCA issues a verdict - to allow or not to engage in maintenance. Thus, the maximum period for which you can get the right to engage in technical inspection is 18 working days.

The certificate is reissued in four cases: expanding or reducing the scope of accreditation, changing the name of the operator, changing the place of residence, first name, surname and patronymic of the IP operator, increasing or decreasing the number of maintenance points or changing their addresses.

Recall that . So the certificate will be issued only after the payment is made. If the companies refused, the money will be returned "within 7 working days from the date of such a decision." The accreditation certificate is issued to the applicant personally against signature or sent by mail with a declared value.

It is noteworthy that the operator must annually (no later than the 15th day of the 12th month after the month in which the certificate was received) confirm compliance with the accreditation requirements and pay the appropriate fee.

In case of loss or damage to the certificate, a duplicate is issued. To do this, you just need to write an application. A duplicate of the accreditation certificate is issued with the mark "duplicate" in one copy.

The PCA may suspend or revoke the certificate. The reason for such a decision may be the very first violation of maintenance rules or accreditation requirements, violation of the procedure for transferring information to single system or denial of annual confirmation of compliance with accreditation requirements. Only the RSA can renew the validity of the certificate on the basis of an audit.

The reason for the cancellation of the certificate may be directly the desire of the operator to stop its activities, two or more violations during the year, or the liquidation of the legal entity.
